Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TrendMind AI service ("Service") provided by TrendMind AI ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Who you are contracting with

You are contracting with TrendMind AI. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

TrendMind AI is an AI-powered co-pilot for content creators that surfaces trends, generates content ideas, analyzes competitors, and simulates viral potential.

3. Acceptance

By continuing to use the Service you agree to these Terms and our Privacy Notice. If you do not agree, do not use the Service.

4. Acceptable use

You must not misuse the Service. In particular, you agree not to: use it unlawfully; commit fraud or spam; infringe the intellectual property or privacy rights of others; interfere with security (malware, probing, scraping, denial of service); or reverse-engineer, resell, or circumvent technical limits of the Service.

5. AI outputs and responsibility

The Service uses generative AI to produce trend analyses, ideas, scripts, and simulations. You are responsible for the prompts you submit, how you use the outputs, verifying their accuracy, and ensuring you have the necessary rights to any content you input. Outputs may be inaccurate or incomplete and are not a substitute for professional advice (legal, financial, medical, or otherwise).

You must not use the Service to generate illegal content, deepfakes intended to deceive, hate speech, harassment, malware, or content that infringes third-party rights. We may remove content, refuse or filter outputs, and suspend accounts for repeat or serious violations. If you believe outputs infringe your rights, contact us with a takedown request and we will act on legitimate complaints.

6. Intellectual property

TrendMind AI and all associated software, documentation, and branding are owned by TrendMind AI and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. As between you and us, you retain ownership of content you input; you grant us a limited license to host, process, and display it solely to provide the Service.

7. Accounts

You must provide accurate registration information and keep it current. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

8. Payments, subscriptions, taxes, and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Service level

We work hard to keep the Service available, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. On termination you may lose access to content stored in your account; where practical we will provide a reasonable window to export your data before deletion.

11. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where the law does not permit exclusion.

12. Indemnity

You will indemnify us against third-party claims arising from your content, your unlawful use of the Service, or your violation of these Terms.

13. Changes

We may update these Terms from time to time. Material changes will be notified in-app or by email. Continued use after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws applicable at the seller's principal place of business, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of that jurisdiction.
